Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Umut Demirci, operating as Soulware (“Soulware”, “we”, “us”, “our”), governing your use of the Uplift mobile application and related services (the “App”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. By using the App, you confirm that you meet this requirement and that you are able to enter into a binding agreement.
2. License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, for your own personal, non-commercial use, as permitted by the App Store Terms of Service.
3. Your responsibilities
You agree to use the App only for lawful, personal purposes and not to:
- copy, modify, reverse-engineer, decompile, or attempt to extract the source code of the App, except as permitted by law;
- use the App to violate any law or the rights of any person;
- interfere with or disrupt the App or its security; or
- attempt to manipulate, misuse, or extract the underlying AI system, or use it to generate harmful, illegal, or abusive content.
4. Not professional advice; your wellbeing
Uplift is a motivation and self-improvement tool. It is not a healthcare service and is not a substitute for professional medical, psychological, mental-health, financial, or legal advice. The coach — including its chat and voice features — provides encouragement and general motivation only, and does not diagnose, treat, or provide therapy.
If you are in crisis or may be a danger to yourself or others, do not rely on the App. Contact a qualified professional, a crisis line, or your local emergency services immediately. You are responsible for decisions you make about your health, goals, and life.
5. AI features
The App generates coaching messages and spoken responses using artificial intelligence. These responses are provided for convenience and motivation only, may be inaccurate, incomplete, or inappropriate, and are not professional advice. You are responsible for reviewing and deciding what to do with anything the coach suggests.
6. Subscriptions, free access, and payments
The App offers a free experience with limited features and optional paid subscriptions that unlock additional features.
- Subscriptions are offered on weekly, monthly, and yearly plans. Purchases are processed by Apple through your App Store account and are subject to Apple’s terms. We do not process or store your payment details.
- Paid subscriptions are billed in advance on a recurring basis and renew automatically unless you cancel at least 24 hours before the end of the current period.
- You can manage or cancel a subscription in your device’s Settings → Apple Account → Subscriptions.
- Fair use. Premium “unlimited” voice coaching is subject to reasonable fair-use limits (currently a generous monthly allowance of voice-conversation minutes) so we can keep the service sustainable. Text coaching remains unlimited, and we’ll let you know in the App if you approach the voice limit.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
- Prices and features may change; we will provide notice where required, and any change applies to future billing periods.
- Refunds are handled by Apple in accordance with its policies.
7. Intellectual property
The App, including its design, text, graphics, logos, and software, is owned by Soulware or its licensors and is protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or branding. The goals and content you create remain yours.
8. Third-party services
The App relies on third-party services — including AI providers (Anthropic and ElevenLabs), hosting (Cloudflare), analytics and crash-reporting tools (Mixpanel and Sentry), subscription management (RevenueCat), and Apple — to function. Your use of those services may be subject to their own terms, and we are not responsible for third-party services we do not control.
9. Disclaimers
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that reminders, notifications, or scheduled calls will always be delivered on time.
10. Limitation of liability
To the maximum extent permitted by law, Soulware will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, missed reminders, or lost opportunities, arising from or related to your use of the App. To the extent we are found liable, our total liability will not exceed the amount you paid for the App in the 12 months before the event giving rise to the claim, or, if you paid nothing, a nominal amount permitted by law. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Soulware from any claims, damages, or expenses arising from your misuse of the App or your violation of these Terms or the rights of any third party.
12. Termination
You may stop using the App at any time and delete it from your device. We may suspend or end your access to the App if you violate these Terms or if we discontinue the App. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
13. Changes to the App and these Terms
We may update, change, or discontinue features of the App at any time. We may also update these Terms; when we make material changes, we will update the “Last updated” date above. Your continued use of the App after changes take effect means you accept the revised Terms.
14. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules. The courts located in Türkiye will have jurisdiction over any dispute, except where mandatory consumer-protection laws of your country of residence provide otherwise.
15. Apple App Store — additional terms
The following terms apply because you obtained the App through Apple’s App Store:
- These Terms are between you and Soulware only, not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide any maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
- Apple is not responsible for addressing any claims relating to the App, including product-liability, legal/regulatory, or consumer-protection claims, or claims that the App infringes a third party’s intellectual-property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
